This privacy policy (“Privacy Policy”) applies to all visitors and users of chatwoot.com's hosted services and websites (the “Website” or “Websites”) and self-managed installations offered by YourChat.name (“YourChat” or “we” or “us”). Please read this Privacy Policy carefully. By accessing or using any part of the Websites or self-managed installations, you acknowledge that you have been informed of and agree to our practices regarding your personal information and data.

What information YourChat collects and why
Information from website visitors

Like most website operators, YourChat collects basic non-personally identifiable information about website visitors, such as browser type, language preference, referring site, and the date and time of each visitor request. We collect this information to better understand how visitors use the Website, to improve our Websites and visitor experience, and to monitor the security of the Websites. From time to time, YourChat may publicly disclose non-personally-identifying information collected from visitors to the Website in the aggregate, e.g., by publishing a report on trends in Website usage.

YourChat also collects potentially personally-identifying information, such as visitors' Internet Protocol (IP) addresses. However, YourChat does not use such information to identify or track individual visitors. We collect this information to understand how visitors use the Websites, to improve performance and content, and to monitor the security of the Websites.

YourChat may collect statistics about the behavior of visitors to our Websites. For example, YourChat may show how many downloads a particular version has received by using aggregated statistics that contain only anonymous user information.

YourChat Self-Managed Instances Usage Information

YourChat collects usage information from each self-managed instance of YourChat (Community Edition and Enterprise Edition). We do not track your end users, but we do track usage of these instances at an aggregate level - you can also disable sending this information using the environment switch in the app.

Personally-identifiable information

Website users may choose to interact with YourChat in ways that provide us with their personally identifying information. In some cases, User ID is generated to track forms and urls, page views, pings and usage counts to determine product performance and development. The amount and type of information YourChat collects depends on the nature of your interaction with us and what information you choose to share. For example, we ask visitors who use our live chat widget to provide their full name and email address. We also collect information that you provide to us in connection with creating an account on the Website.

If you report a security vulnerability to YourChat and request public confirmation, we may publicly disclose the personal information you provide to us in connection with the report, including your name, to fulfill your request for confirmation. In each case, YourChat collects such personal information only to the extent necessary or appropriate to fulfill the purpose of the user's interaction with or request to YourChat. We do not disclose personally identifiable information other than as described in this Privacy Policy.

Visitors can always opt out of providing personally identifiable information, with the caveat that doing so may prevent you from engaging in certain website-related activities or accessing and using certain features and services. For details on what information is collected and to whom it is shared, please refer to the tracking technology.

Information YourChat does not collect
Chatwoot does not knowingly collect sensitive personal information such as social security numbers, genetic data, health information, or religious information. While YourChat does not request or collect sensitive personal information, we understand that users may store such information in a YourChat instance by transmitting it to us via chat, libraries, or APIs. If you store any sensitive personal information on YourChat servers, you consent to the storage of that information on our servers, which are located in the Netherlands.

If you are a child under the age of 13, you may not have an account on the Website. YourChat does not knowingly collect information from children under the age of 13 or direct any of our Website or content specifically to them. If we learn or have reason to suspect that a user is under the age of 13, we will terminate their account. Other countries may have different minimum age limits. If you are under the minimum age to consent to data collection in your country, you may not use YourChat.

Legitimate Interests: We use your information for our legitimate interests, such as to provide you with better content through our websites and to communicate with users and the public, to improve and promote our products and services, and for administrative, security, fraud prevention and legal purposes.

Consent: We may rely on your consent to use your personal information for certain direct marketing purposes, such as sending you news about YourChat products. You may withdraw your consent at any time by using the unsubscribe feature provided in each marketing email or by contacting us at the addresses listed at the end of this Privacy Policy.

We, as well as our service providers and third party partners, may use artificial intelligence (AI) and machine learning technologies, including generative AI, to process the personal data described above. Please note, however, that any data collected through Google Workspace APIs is not used to develop, improve or train generalized AI and/or machine learning models.

How YourChat uses and protects personally identifiable information
Sharing your information

YourChat discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on behalf of YourChat or to provide services available at the site, and (ii) that have agreed not to disclose it to others.

Please note that email addresses and IP addresses of users of YourChat deployments may be shared with the appropriate users of that deployment.

Chatwoot will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, YourChat discloses potentially personally-identifying and personally-identifying information only when required to do so by law or when YourChat believes that disclosure is necessary to protect the property or rights of YourChat, third parties or the public at large.

YourChat takes measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

YourChat, at its discretion, may use company logos where those companies use the software we provide. If you have concerns about the use of your logo, please contact hello@yourchat.name.

International transmission of information

The Website is located in the Netherlands and the information we collect will be stored and processed on our servers in the Netherlands. Our employees, contractors and affiliated organizations that process information for us as described above may be located in the Netherlands, the United States, India or other countries outside of your country; by using the Website, you consent to the international transfer of your information by YourChat .

YourChat's communication with you

If you are a registered user of the Websites and have provided your email address, YourChat may send you emails from time to time to update you on security, system information, new features, ask you to leave feedback, or just to keep you up to date on what's going on with YourChat and our products. We primarily use our blog to communicate this kind of information, so we expect to keep these emails to a minimum. There is an unsubscribe link at the bottom of each of the marketing emails we send you, so you can stop receiving such emails at any time.

If you send us a query (for example, by emailing our support team or through one of our feedback mechanisms), we reserve the right to publish your query to help us clarify or respond to your query or to help us support other users. We will not publish your personal information in connection with your request.

Cookies, Tracking Technologies and Tracking Prohibition
Cookies

A cookie is a string of information that a website stores on a visitor's computer and that the visitor's browser provides to the website whenever the visitor returns. YourChat uses cookies to help YourChat identify and track visitors, their website usage, and their website access preferences. YourChat visitors who do not wish to have cookies placed on their computers can set their browsers to refuse cookies before using the websites. Disabling cookies in your browser may prevent certain features of the YourChat Websites from functioning properly. Some pages on the Websites may have cookies set by other third parties. For example, we may embed content, such as videos, from another website that sets cookies. These sites set their own cookies and we do not have access to or control over these cookies. The use of cookies by third parties is not covered by our Privacy Policy.

Tracking Technologies

We may use third-party tracking services, but we do not use these services to individually track you or collect personal information about you. We may use these services to collect information about how the Website operates, how users navigate and use it, so that we can monitor and improve our content and the operation of the Website. Third-party tracking services collect certain simple, non-personally identifiable information over time, such as your IP address, browser type, Internet service provider, referring and exit pages, timestamp, and similar data about your use of the Website. We do not associate this information with any of your personal information, such as your username.

Do Not Track

“Do Not Track” is a privacy preference you can set in your browser if you do not want online services to collect and share certain types of information about your online activity from third-party tracking services. YourChat does not track your online activity across other online services over time, and we do not allow third-party services to track your activity on our site beyond our basic tracking, which you can opt out of. Because we do not share such data with third-party services or allow third-party data collection for our users, and we do not track our users across third-party sites, we do not need to respond differently to a Do Not Track browser setting.

Global Privacy Practices
The information we collect will be stored and processed in the Netherlands in accordance with this Privacy Policy, but we understand that users in other countries may have different expectations and rights regarding their privacy. For all visitors and users of the Website, regardless of the country they are located in, we will provide clear means of unambiguous, informed consent when we collect your personal information;
collect only the minimum amount of personal data necessary for the purpose for which it is collected, unless you choose to provide us with more;
offer you simple methods to access, correct, or delete the information we collect, with the exception of information you voluntarily provide that must be kept intact to ensure the integrity of our project code, as described below;

Retention and Deletion of Data
If you already have an account on the Websites, you can access, update, change, or delete your primary user profile information by logging into your account and updating your profile settings.

Changes to this Privacy Policy
Although most changes are likely to be minor, YourChat may change its privacy policy from time to time and in YourChat’s sole discretion. We may also notify users who have provided us with email addresses about significant changes to this Privacy Policy through our website. YourChat encourages visitors to frequently check this page for any minor changes to the Privacy Policy. Your continued use of this site following the posting of changes to this Privacy Policy will constitute your acceptance of those changes.
